Fair Usage Policy

Effective as of the date you subscribe to a Panel Nexus plan.

Panel Nexus plans may include features described as “Unlimited”. Unlimited features are provided subject to reasonable and fair usage of the Platform and do not constitute unlimited computing, storage, bandwidth, database, processing, API, or other infrastructure resources.

1. Fair Usage

Customers may use Panel Nexus for legitimate survey research, panel management, project management, respondent management, reconciliation, and other functionality provided through the Platform.

Usage must remain reasonably consistent with the nature of the subscribed plan and normal use of Panel Nexus by research teams.

Panel Nexus reserves the right to review accounts exhibiting unusually high resource consumption or usage patterns that may adversely affect the Platform or other customers.

2. Unlimited Projects

Where a paid plan includes unlimited projects, customers may create and manage any reasonable number of legitimate research projects.

“Unlimited Projects” does not permit:

  • creation of projects primarily for automated data storage or archival purposes;
  • bulk creation of dummy, duplicate, test, or machine-generated projects;
  • using projects as a substitute for file, database, or data-storage services;
  • automated project creation that generates excessive Platform or server load; or
  • activity intended to circumvent limits applicable to the subscribed plan.

Monthly completes and any other usage limits specified for the subscribed plan continue to apply.

3. Prohibited and Excessive Usage

Customers must not use the Platform in a manner that:

  • causes excessive CPU, memory, database, storage, bandwidth, network, or other infrastructure consumption;
  • generates excessive automated requests, redirects, queries, exports, imports, or other transactions;
  • uses bots, scripts, crawlers, scraping tools, or other automated systems in a manner not expressly supported by Panel Nexus;
  • attempts to bypass plan limits, security controls, rate limits, or technical restrictions;
  • interferes with or degrades Platform performance for other customers;
  • probes, scans, attacks, exploits, reverse engineers, or attempts unauthorized access to the Platform or its infrastructure;
  • introduces malware, malicious code, denial-of-service traffic, or other harmful content or activity; or
  • uses Panel Nexus infrastructure to operate unrelated applications, services, data-processing workloads, or storage systems.

4. Automated Access and Rate Limiting

Panel Nexus may apply reasonable technical controls, including request limits, rate limits, concurrency limits, processing limits, file-size limits, export limits, storage limits, or temporary throttling where necessary to maintain Platform security, stability, availability, and performance.

Such controls may be applied even where a particular feature is described as unlimited.

5. Excessive Resource Consumption

If an account consumes resources substantially beyond reasonable usage for its subscribed plan, Panel Nexus may contact the customer to discuss appropriate measures.

These measures may include optimization of usage, reasonable technical restrictions, migration to a more appropriate plan, additional infrastructure charges, or a custom enterprise arrangement.

Where reasonably practicable, Panel Nexus will provide notice before imposing material restrictions resulting solely from excessive legitimate usage.

6. Immediate Protective Action

Panel Nexus may immediately throttle, restrict, suspend, or isolate an account without prior notice where reasonably necessary to:

  • protect Platform infrastructure;
  • prevent security incidents;
  • stop malicious or abusive activity;
  • prevent material degradation of service to other customers;
  • respond to unusually high automated traffic; or
  • protect Panel Nexus, its customers, infrastructure providers, or third parties from harm.

Panel Nexus will make reasonable efforts to restore normal access after the relevant risk has been resolved.

7. Circumvention of Plan Limits

Customers must not create multiple accounts, workspaces, organizations, projects, identities, or other resources for the purpose of avoiding applicable subscription, completes, user, usage, or other plan limits.

Panel Nexus may aggregate related accounts when determining whether plan limits or fair usage requirements have been exceeded.

8. Storage and Data Retention

Panel Nexus is not intended to serve as a permanent backup, archival, file-hosting, or general-purpose data-storage service.

Reasonable limits may be applied to file uploads, storage consumption, exports, logs, archived projects, backups, and historical data.

Customers remain responsible for maintaining copies of data they are legally or operationally required to retain.

9. Service Availability

Panel Nexus will use commercially reasonable efforts to maintain Platform availability. However, uninterrupted or error-free operation is not guaranteed.

Temporary interruptions may occur due to maintenance, upgrades, security measures, infrastructure failures, third-party services, internet or telecommunications failures, circumstances beyond reasonable control, or emergency maintenance.

10. Modification of Fair Usage Limits

Panel Nexus may introduce or modify reasonable technical and fair-usage limits where necessary to protect Platform stability, security, or sustainability.

Where a change materially affects normal legitimate usage of a paid subscription, Panel Nexus will make reasonable efforts to provide advance notice.

11. Enforcement

Panel Nexus will ordinarily attempt to contact customers regarding excessive legitimate usage before materially restricting an account.

This notice requirement does not apply to suspected fraud, security threats, malicious activity, deliberate circumvention, illegal activity, or situations requiring immediate action to protect the Platform.

Repeated or serious violations may result in suspension or termination of the account in accordance with the applicable Terms of Service.
